Plain English summary: Your capsules are stored on your device or in Apple's CloudKit infrastructure. We cannot read them. We don't sell your data. If MemoriMe shuts down, we will make every reasonable effort to give you advance notice to retrieve what you can. This policy includes rights for users in the EU (GDPR) and California (CCPA).
MemoriMe stores your capsules β voice memos, photos, notes, and videos β locally on your device using Apple's SwiftData framework. We do not have access to this data. It lives on your device and nowhere else unless you choose to send a capsule to another person.
We do not collect your name, email address, or any personally identifiable information. We do not use analytics, advertising SDKs, or tracking of any kind.
When you seal a capsule, MemoriMe may capture your approximate location and local weather as ambient context. This data is stored only within your capsule on your device. It is never transmitted to us or any third party.
When you send a capsule to another person, the capsule content is stored in Apple's CloudKit public database. We do not have the ability to read, access, or modify the contents of capsules stored in CloudKit. The data is encrypted in transit by Apple and stored under Apple's infrastructure, not ours.
Because we do not store or have access to your capsule contents β whether locally stored or in CloudKit β we are technically unable to produce them in response to legal requests. Capsules stored locally on your device are accessible only to you and to Apple under Apple's own legal policies. Capsules stored in CloudKit are governed by Apple's law enforcement guidelines, available at apple.com/legal/privacy. We will notify users of any legal requests directed at us to the fullest extent permitted by law.
Subscription payments are processed entirely by Apple through the App Store. We do not have access to your payment information at any time.
Your capsules stored locally on your device persist until you delete them or uninstall the app. Capsules sent to others via CloudKit remain in Apple's infrastructure until the recipient opens them. We have no duty to recover or back up locally stored data, and we are not liable for data loss arising from hardware failure, device loss, or circumstances outside our control.
Important: If MemoriMe ceases operations, we will make every reasonable effort to provide advance notice to allow users to retrieve or export content where technically possible. This is our stated intention and not a legally binding guarantee. Capsules that have not been opened or saved outside the app may be permanently lost if the service ends. You are encouraged to export or back up important capsule content independently.
MemoriMe is not directed at children under 13. We do not knowingly collect data from children under 13. Because MemoriMe captures location data as part of the capsule-sealing process, users must be 13 or older to use the app. If you are a parent or guardian and believe your child under 13 has used MemoriMe, please contact us at [email protected] and we will take appropriate steps. Users between 13 and 18 should review these terms with a parent or guardian.
If you are located in the European Union or European Economic Area, you have the following rights under the General Data Protection Regulation (GDPR):
- Right of access: You may request confirmation of whether we process your personal data and, if so, a copy of that data.
- Right to rectification: You may request correction of inaccurate personal data.
- Right to erasure: You may request deletion of your personal data where we hold it. Because capsule content is stored on your device or in Apple's CloudKit infrastructure β not by us β deletion of that content must be performed by you directly within the app or by contacting Apple.
- Right to data portability: You may request your personal data in a structured, commonly used format to the extent we hold it.
- Right to object: You may object to processing of your personal data in certain circumstances.
- Right to lodge a complaint: You have the right to lodge a complaint with your local data protection authority.
Because MemoriMe does not collect personally identifiable information and all capsule content is stored locally on your device or in Apple's infrastructure, our ability to fulfill certain requests may be technically limited. To exercise any of these rights, contact us at [email protected].
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA):
- Right to know: You may request disclosure of the categories and specific pieces of personal information we have collected about you.
- Right to deletion: You may request deletion of personal information we have collected from you, subject to certain exceptions.
- Right to opt out of sale: We do not sell your personal information. No opt-out is necessary.
- Right to non-discrimination: We will not discriminate against you for exercising any of your CCPA rights.

Plain English summary: You own your content. We provide the service as-is. Subscriptions are handled by Apple. Use the app honestly and don't store harmful content. Disputes are resolved through binding arbitration in Florida. We are not liable beyond the amount you paid us in the last 6 months.
By downloading or using MemoriMe, you agree to these terms. If you don't agree, please don't use the app. Users under 18 should review these terms with a parent or guardian.
MemoriMe is a time capsule app that lets you seal memories β voice memos, photos, notes, and videos β to be opened at a future date. You can keep capsules for yourself or send them to people you choose.
You own everything you create in MemoriMe. We claim no rights to your capsules, their contents, or any data you store within the app. You are solely responsible for ensuring your content does not violate any applicable laws or the rights of others.
You agree to indemnify, defend, and hold harmless Caywood Creative LLC, its officers, agents, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the app; (b) your capsule content; (c) your violation of these terms; or (d) your violation of any third-party rights, including intellectual property or privacy rights. This indemnification obligation survives termination of these terms and your use of the app.
You agree not to use MemoriMe to store or send content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. We reserve the right to terminate access for violations of these terms.
MemoriMe offers free and paid subscription tiers. Paid subscriptions are billed through Apple and are subject to Apple's payment terms and cancellation policies. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions at any time through your Apple ID account settings.
We do not process or store payment information. All billing is handled exclusively by Apple.
Capsules sent to other users are stored in Apple's CloudKit infrastructure. We do not control, access, or read the contents of these capsules. Delivery to recipients depends on MemoriMe remaining an active, available application and on recipients having the app installed.
We cannot guarantee delivery of capsules if technical failures occur, if the recipient does not have the app installed, or if the service is discontinued. Sending a capsule through MemoriMe does not constitute a guaranteed delivery mechanism.
This section is important. Please read it carefully.
Capsules stored locally on your device may be lost if you delete the app, lose your device, or if your device fails. We have no duty to recover or back up locally stored data. We strongly encourage you to maintain device backups through iCloud or iTunes.
Capsules that have not been opened, saved, or exported at the time MemoriMe ceases operations may be permanently and irrecoverably lost. We are not liable for the loss of capsule content under any circumstances, including but not limited to app discontinuation, device failure, accidental deletion, or technical error.
If MemoriMe ceases operations, we will make every reasonable effort to provide users with advance notice and, where technically possible, a means to export or retrieve their content. This is our stated intention and does not constitute a legally binding obligation.
We do not have the technical ability to access, read, or reproduce the contents of your capsules, whether stored locally or in CloudKit. In the event of a legal request directed at us, we will comply to the extent required by law but cannot produce content we do not have access to.
MemoriMe is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or that capsules will be delivered at the precise time or in the precise manner intended.
To the fullest extent permitted by applicable law, MemoriMe and Caywood Creative LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of capsule content, or loss of revenue, arising out of or related to your use of the app.
Notwithstanding any other provision of these terms, our total cumulative liability shall not exceed the greater of (a) the total amount you paid for MemoriMe subscriptions in the six (6) months immediately preceding the claim, or (b) ten dollars ($10.00 USD).
Please read this section carefully. It affects your legal rights.
You and MemoriMe (operated by Caywood Creative LLC) agree that any dispute arising out of or relating to these terms will be resolved through binding individual arbitration administered by the AAA under its Consumer Arbitration Rules (adr.org), in Orange County, Florida or via videoconference. The arbitrator's decision is final and binding.
You and MemoriMe each waive the right to a jury trial and to participate in any class action or representative proceeding.
All claims must be brought on an individual basis only. You may not participate as a plaintiff or class member in any class action, collective action, or representative proceeding.
We may update these terms as the app evolves. We will notify users of material changes through the app or App Store update notes. Continued use after notice constitutes acceptance.
We reserve the right to suspend or terminate your access to MemoriMe at any time for violations of these terms or for any other reason at our sole discretion. We will make reasonable efforts to provide advance notice where practicable, but are not obligated to do so.
These terms are governed by the laws of the State of Florida. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of courts in Orange County, Florida.
We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, or infrastructure failures.
If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, with remaining provisions continuing in full force. These terms, together with our Privacy Policy, constitute the entire agreement between you and MemoriMe.
